Breadmate Terms and Conditions
1. About these Terms
1.1 These Terms and Conditions ("Terms") govern your access to and use of the Breadmate online loan application portal at breadmate.com.au (the "Portal") and any loan application you submit through it.
1.2 When you reach the end of your application, you will be asked to confirm that you have read and accept these Terms, our Privacy Policy, and our Credit Guide. You provide that acceptance through the consent declarations before you submit your application (see clause 8). If you do not accept them, you cannot submit an application.
1.3 These Terms apply to your use of the Portal. The terms of any loan we offer you will be set out in a separate credit contract. If there is any inconsistency between these Terms and a credit contract you enter into, the credit contract prevails in respect of that loan.
1.4 We may update these Terms from time to time. The version in force is the version published on the Portal at the time you use it. Continued use after a change means you accept the updated Terms.
2. Definitions
Applicant / you means a person who registers for or uses the Portal to apply for a loan.
Credit Guide means the Breadmate Credit Guide made available to you before or during your application.
Loan means a Small Amount Credit Contract (SACC) or Medium Amount Credit Contract (MACC) offered by Breadmate.
Privacy Policy means the Breadmate Privacy Policy, available on the Portal.
Third-Party Services means the external service providers we use to help operate the Portal, as described in clause 10.
3. Eligibility
3.1 To apply for a loan through the Portal, you must:
- be at least 18 years of age;
- be an Australian Citizen, Permanent Resident, or New Zealand Citizen. Visa holders are not eligible to submit an application through the Portal;
- provide a valid Australian residential address;
- not be currently unemployed;
- verify ownership of your nominated email address; and
- accept the consents described in clause 8.
3.2 Meeting the eligibility criteria does not guarantee that a loan will be approved. All applications are subject to assessment.
4. Your Account
4.1 To start an application, you create an account by verifying your email address and setting a password. Your verified email address is your login credential. Creating an account and completing the application do not require you to accept these Terms; you accept them at the end of your application, before you submit it (see clause 8).
4.2 You are responsible for keeping your password secure and for all activity that occurs under your account. You must notify us promptly if you believe your account has been accessed without your authorisation.
4.3 You must provide information that is true, accurate, current, and complete. Providing false or misleading information may result in your application being declined and may have consequences under law.
4.4 We store your password in hashed form only. We never store or log your plaintext password. Sessions are managed securely and end when you log out or after a period of inactivity. Password reset is available through a time-limited link sent to your registered email.
5. The Application Process
5.1 A loan application is completed in stages, which include: email verification, registration, personal details, loan details, employment and income, monthly expenses, assets and liabilities, nomination of a trusted contact, and review and submission.
5.2 When you submit your application, it is locked and no further edits are possible through the Portal.
5.3 After submission, you will be directed to complete a secure bank statement verification, followed, where applicable, by identity verification (see clause 9).
5.4 A trusted contact you nominate is not a guarantor and is not liable for your loan. We may contact that person only if we are unable to reach you. You confirm that you have the nominated person's consent to provide their details.
6. Loan Products and Fees
6.1 The Portal offers two products. The fees and structure below are indicative and are set out in full in your credit contract and Credit Guide.
Small Amount Credit Contract (SACC)
- Loan amount: $300 to $2,000
- Term: 3 to 12 months
- Establishment fee: 20% of the principal, charged once at commencement
- Monthly fee: 4% of the principal per month (flat)
Medium Amount Credit Contract (MACC)
- Loan amount: $2,001 to $5,000
- Term: 3 to 24 months
- Establishment fee: $400, factored into each monthly repayment
- Interest rate: 48% per annum (amortising)
6.2 Any repayment figure shown in the Portal before you enter a credit contract is an estimate only. The binding figures are those in your credit contract.
7. Assessment and Lending Decisions
7.1 To assess whether a loan is suitable and affordable for you, we collect and verify your income, expenses, employment, and bank statement information.
7.2 All lending decisions are made by Breadmate through its authorised staff, in accordance with our lending criteria and responsible lending obligations.
7.3 Once a decision is recorded, it is final and cannot be changed by you through the Portal.
7.4 We are not obliged to approve any application, and we may decline an application without being required to give reasons, except where the law requires otherwise.
7.5 If you wish to discuss the outcome of your application, you may contact us or use the complaints process set out in clause 16.
8. Consents
8.1 Before submitting your application, you must confirm that you have read and accept:
- these Terms and the Privacy Policy;
- the Privacy Policy (as a separate confirmation); and
- the Credit Guide.
8.2 All three consents are required. We record the date and time you provide them against your application.
9. Bank Statement and Identity Verification
9.1 Bank statement verification. You will complete a secure bank statement connection through an accredited open banking service. That service collects your bank information directly from you through its own interface and returns a verified summary of your income, expenses, and surplus to us. We do not receive your online banking login details.
9.2 Identity verification. As part of processing your application, we may ask you to verify your identity by submitting document details (such as an Australian Driver Licence, Passport, or Medicare Card) through our identity verification service, which checks those details against the relevant government registry via the Australian Government Document Verification Service (DVS). We record the result of that check.
10. Third-Party Services and Privacy
10.1 We use trusted third parties to help operate the Portal, including a customer records system, a bank statement analysis service, an identity verification service, and a transactional email service. Some of these providers may store data outside Australia.
10.2 How we collect, use, disclose, store, and (where applicable) transfer your personal and financial information is described in our Privacy Policy, which forms part of your agreement with us. Please read it before you apply.
10.3 We handle your information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.
11. Your Obligations and Acceptable Use
11.1 You agree to use the Portal only for lawful purposes and only to submit your own genuine loan application.
11.2 You must not:
- submit false, misleading, or fraudulent information;
- apply on behalf of another person or impersonate anyone;
- attempt to gain unauthorised access to any part of the Portal, including the admin area;
- interfere with, disrupt, or attempt to compromise the security or operation of the Portal; or
- use any automated means to access or scrape the Portal.
11.3 We may suspend or terminate your access if we reasonably believe you have breached these Terms or engaged in fraudulent or unlawful conduct.
12. Intellectual Property
12.1 The Portal, its content, design, and software are owned by or licensed to Breadmate and are protected by law. Except as needed to use the Portal for its intended purpose, you may not copy, modify, distribute, or create derivative works from any part of it without our written consent.
13. Availability and Disclaimers
13.1 We aim to keep the Portal available and functioning, but we do not guarantee it will be uninterrupted, error-free, or secure at all times. Access may be suspended for maintenance, updates, or reasons outside our control.
13.2 To the extent permitted by law, the Portal is provided on an "as is" and "as available" basis. Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term implied or imposed by law (including the Australian Consumer Law) that cannot lawfully be excluded.
14. Limitation of Liability
14.1 To the maximum extent permitted by law, and subject to clause 13.2, Breadmate is not liable for any indirect, incidental, or consequential loss arising from your use of, or inability to use, the Portal.
14.2 Nothing in these Terms limits liability that cannot be limited under Australian law, including under the National Consumer Credit Protection Act 2009 (Cth) and the Australian Consumer Law.
15. Termination
15.1 You may stop using the Portal at any time.
15.2 We may suspend or close your account where required by law, where you breach these Terms, or where we reasonably consider it necessary to protect the Portal or other users. Closure of your account does not affect the terms of any credit contract already entered into.
16. Complaints and Disputes
16.1 If you have a complaint, please contact us using the details in clause 18. We will handle your complaint through our internal dispute resolution process.
16.2 If your complaint is not resolved to your satisfaction, you may be entitled to refer it to the Australian Financial Complaints Authority (AFCA). Our AFCA membership details are set out in our Credit Guide.
17. Governing Law
17.1 These Terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts of that jurisdiction.
